brain cells itch the latest on the disappearance of victoria masony. >> 400 people in flame, boats and helicopters scouring the waters off the coast of venezuela for the better part of seven days. they have not found any sign of wreckage. >> the family has become convinced that they are still alive. now masony's eldest son is hinting to an italian paper that his father may have been kidnapped. >> all that and much more. but first, a top republican on the senate budget republican committee vowing not to allow jeff lieu to become treasury of secretary, accusing him of misrepresenting the impact on the budget, referring to a bitter 2011 senate hearing. >> you said in your interview sunday with candy crowley, our budget will get us over the next several years to the point where we can look the american people in the eye and say we are not adding to the debt any more.
1:03 am
we are spending money that we have seech year. then we can work on bringing down the national debt. was that an accurate or misleading statement to the american people, sunday? >> senator, i think it's an accurate statement that our current spending will not be increasing the debt. we do have interest payment, it is going to take awhile -- >> well, you didn't say that. >> you said we will be bringing down the debt during the period of this budget and we can look them in the eye and say we are not adding to the debt anymore -- that's not accurate. >> i believe it is accurate. our current programs, the things we are making decisions on, we have stopped spending money we don't have. we can't wish the national debt away. >> greta: senator sessions is here. good evening, sir. >> good evening. >> greta: senator, am i right in my characterization that -- that have you accused jack lew of lying to the senate? >> look, he came in and
1:04 am
testified to represents the most colossal, fantastical financial misrepresentation, i think, in history. he said that debt, he told the american people square on, that we would not be adding to the debt, we would spend only the money that we have and begin to pay down the debt. that was utterly untrue. his budget did nothing like that. the lowest deficit in 10 years that he projected in his own numbers was $600 billion deficit and would have added $13 trillion to the debt. remember, this is after 2010 when the republican house was elected and hopefully, we were in a point to make some fundamental changes in spending in america and they came out with a budget that did just the opposite. and he told the american people what they wanted to hear. but it wasn't the truth. >> greta: all right. just to zero in, there is a big difference between being mistaken or i mean, having a

different viewpoint and trying to be deceitful and a lie. that's very different. where does he fall in the spectrum, in your opinion? >> i gave him a chance at the hearing -- he had already said the statements publicly. i quoted them back to him. he said it was accurate. he defended those statements, although i will acknowledge that secretary geithner who followed him would not say so. he knew that wasn't accurate. he acknowledged that the president's budget didn't put us on a sustainable path, but not mr. lew. he continued to spin and repeat those statemented and the president was running ads on it in september right before the election, saying the same thing, that his budget paid down the debt. it is absolutely not true. >> greta: is there anything jack lew could say at a hearing that would redeem him in your eyes? >> well, we would see. i mean, he will have an opportunity to do that. but fundamentally, from eating a
1:06 am
little crow is not going to satisfy my feeling about it because i think he knew exactly what he was doing. he should have told the president, i cannot say that, mr. president. i will not say that. i valid to resign before i go out before the committee and try to promote such an idea that our budget is going to pay down the debt. >> greta: well, you have been quoted as saying he will never be secretary of the treasury. do you think that he won't be voted by the committee and voted -- confirmed by the senate? >> well, greta, i said that i felt he must never be. we will see, the full senate will decide. i will just have one vote on it. but i do think that the senate needs to -- push back against this idea that people can come before our committees and say anything they want to, inaccurately and then waltz in two years later and be promoted to the most significant
1:07 am
financial office in our country, really in the world, the secretary of treasury. we shouldn't treat that lightly. he needs to be held to account in my opinion. if -- so i -- that's my strong feeling about it. >> greta: i tell you, you are not alone. and senator bernie sanders has indicated he will not vote for him, that he will vote no, for very different reasons. he believes he is too cozy with wall street -- cozy is my term, want the word the senator used. on the other end, he will have trouble, too. i am curious, though, looking at the hearing, a step back and looking at what will ask who and how. i see this as one that will give the republicans the opportunity to grill him about the president's plan for the future, the economy, something that the republicans have been saying that they haven't gotten under the president so far. is this going to be a grilling of this candidate, about the
1:08 am
president's policies? >> well, it absolutely should be an opportunity to inquire of hem about the basic principles of this administration. why have they not proposed any solution to our -- our entitlement program? why have they not respond to the law that requires them to lay out a plan to fix medicare, when it gets in financial trouble. it's been certified to be in trouble. the president should be -- have laid out a plan. he has flatly refused to comply with the law. maybe they will ask him why he supported harry reid not bringing up a budget. he supported that and said, you could filibuster a budget. and he well knows, mr. lew, you can't filibuster a budget. it can be passed with a simple majority. i think there are a lot of questions and matter that says could be inquired of at his manager. >> greta: he will have a problem, apparently from senator orrin hatch, the ranking member
1:09 am
on the -- on the finance committee because senator hatch has said he's withholding judgment, he hasn't said "yes" or "no," until the nominee outlines the administration plans to cut spenning, to lower the national debt. so you can see that senator hatch, you know, intends -- that whole business about -- the whole issue of spending cuts -- this -- this nomination hearing is going to be the forum about that particular issue, just like the debt ceiling. >> i think he can be. i think the reason they never brought up a budget is because the democrats would have had to -- defend openly in public debate an unsupportable, indefensible plan that their president was promoting. and they would have had to follow it or reject it. and of course, when lew's budget was brought before the senate and the house, if you remember, greta, it got zero votes -- not a republican or a committee in the -- or a democrat in the
1:10 am
house or the senate voted for a bill that mr. lew was the architect of. i don't think that speaks well for a man who would take on the position of treasury secretary. >> greta: president obama says he facilitates deal, citing president reagan and speaker o'neill on social security and president clinton and a republican congress on the issue of a budget deal. i am curious whether you agree that he has brought the two sides together. if so, where has that been in the last go-round, the last 18 months? >> the last fiscal cliff deal, he -- his chief of staff at the white house, he was involved in the negotiations. they went nowhere until senator mccog urged vice-president bide tone get involved. that's when an agreement was reached. it wasn't jack lew that reached that agreement. he also, when he agreed to the budget spending reductions as part of the budget control act,
1:11 am
18 months ago, he -- he proposed a budget, the next budget that they put forward, wiped out 60% of those cuts, even though he agreed to them in august and january, he was proposing to giving back 60% of them and spending more money -- >> greta: i guess it's pretty clear -- i guess it's pretty clear you have a strong opinion on this one? >> i really do. i can never forget that hearing. it was one of the most dramatic things i have ever participated in. when the office of management and budget looked us in the eye and insisted that they were correctly -- they were correct in saying their budget would have paid down the debt, when it did not. >> greta: senator, always nice to see you. thank you, sir. >> thank you, greta. >> greta: if jack lew becomes treasury secretary, our economy will be in his hands. but can most americans pick lew out of a lineup in griff jenkins

compelling. >> what really happened in there? >> in a nutshell, two people took travis' life, two monsters. >> you did not shoot travis. >> vinever shot a real gun. >> you didn't stab him 27 times. >> that's heinous. >> slit his throat from ear to ear. >> i can't imagine slitting anyone's throat. >> no jury will convict me. >> why not? >> i am not. no jury will convict me. >> greta: trio troy haden is live. you can put the margaritaville comment in context? why was the prosecution asking those questions? >> she said she was working in margaritaville and dropped a glass and got the cuts and not in the knife fight with the terrible murder. she is a liar. the jury knows that. she told three stories about how the murder happened. she said two strange guys did it and also that, oh, yeah, i did it, but it was self-defense.
1:17 am
everyone knows she's a liar and a killer. but the question is now, is it first-degree murder? will she get the death penalty? >> greta: it's beyond beyond a reasonable doubt, when someone starts changing a story three times and both are preposterous, it seems unlikely she will be found not guilty. but she is still presumed innocent. do you have any sense of the defense? there has been a suggestion of self-defense. but has the defense attorneys thrown in the towel? are they trying to spare her life or trying to get her -- does it seem like they believe they will -- that they have a defense, a viable one? >> yeah. i don't know what they believe. but here's what they are trying to do. travis alexander was shot, he was stabbed and his throat was slit. the defense was saying he was shot first, much smaller woman, much larger man. he didn't stop. he kept coming after her and then she stabbed him and she slit his throat and that ended it.
1:18 am
>> the prosecution's saying she stabbed him and in a heinous, terrible, depraved act shot him in the head when he was already dead and that's the strategy. >> what's her demeanor, as she listens to the man that she hooked up with the day after the disceddent died. what was her demeanor? >> she doesn't show a lot of emotion. when the ""inside edition"" interview came up and she said, mark my words, no jury will convict me. she is not assuming a tossen emotion. we are talking about somebody who committed -- admitted to this killing. and 24 hours later, she's on a first date at chilis with another guy. maybe there are two jodis here. >> greta: you can't predict what the jury's thinking. but we look to see how they respond. i take it they are paying close attention and no sense -- they're not smirking or showing disgust or laughing or anything
1:19 am
else, right? >> i mean, they have amazing poker faces. i was talking about that with somebody else. they keep a very calm demeanor on the outside. you the only time i saw a real emotion was pictures of travis alexander's body. i have been around a lot of court cases over the years. i haven't seen much like this. it was a very, very violent killing. >> greta: troy, thank you. >> you got it, greta. >> greta: straight ahead, shocking news in the mysterious disappearance of a fashion mogul's plane? did the plane really crash? hear what his son is now saying? a school district rocked by controversy. a teacher throws an american flag on the floor and stomps on it, all in front of the children. one of the children is here and she will tell you all about it. it's starting, big news about paul ryan. is he running for president in 2016? find out what he just said. searing for a bank designed for investors like you? tdd#: 1-800-345-2550

plane went down. what are his plausible theories, if you know. >> it's interesting that 48 hours after the plane went missing, the son of one of the other passengers on the plane received a text message from his father that said, call now, we're available. and this sort of brought everybody who was looking for them, already looking for the people on the plane, a great sense of hope, they thought perhaps they are somewhere to be found. one of the rumors, the plane was hijacked, kidnapped, kidnapping in venezuela is a fairly regular occurrence, but usually happens in a carjacking, people taken in their cars and held for hours, sometimes held for days, weeks or months. it wouldn't be heard of for a kidnapping to take place for a ransom. but of course for it to happen to a plane, that's unheard of. we've never heard of that. >> greta: missing under that theory is a ransom. if you're kidnapping for a ransom you make a communication, give me the
